These Terms & Conditions (“Terms”) govern your use of The Blindsmen Inc. website and provide general information concerning our products and services.
Project-specific purchases are also governed by the applicable estimate, invoice, contract, product specifications, warranty terms, and other written agreements provided in connection with the project.
The Blindsmen Inc. (“The Blindsmen,” “we,” “us,” or “our”) provides custom window-covering products and related services, including consultation, measurement, supply, motorization, and professional installation.
We primarily serve customers throughout Toronto and the Greater Toronto Area.
The information provided on this website is intended for general informational purposes and to help customers learn about our products and services.
We make reasonable efforts to keep website information accurate and current. However, product specifications, fabrics, colours, availability, pricing, warranties, lead times, and other information may change.
Information displayed on the website does not constitute a binding quotation or guarantee unless expressly included in a written estimate, invoice, or agreement issued by The Blindsmen.
Consultations may be offered to assess your project, take measurements, review product options, and recommend suitable window-covering solutions.
Any preliminary pricing discussed before final measurements and product selections is an estimate only.
The final project scope, specifications, pricing, taxes, deposit requirements, payment schedule, and other applicable charges will be stated in the estimate, invoice, or agreement provided for your project.
Most window coverings supplied by The Blindsmen are custom manufactured or ordered specifically for an individual customer's windows and selections.
Customers are responsible for reviewing and approving the applicable product specifications, including product type, quantities, measurements where applicable, fabric, colour, finish, operating system, motorization, controls, and other selections shown in their project documentation.
Once a custom order has been submitted for production, changes or cancellations may not be possible. Where a manufacturer permits a change or cancellation, additional charges may apply.
Nothing in these Terms limits any consumer right or remedy that cannot legally be waived.
Unless otherwise stated, prices are in Canadian dollars and applicable taxes are additional.
Deposit requirements and payment schedules vary by project and will be stated in the applicable estimate, invoice, or agreement.
The required deposit must generally be received before custom products are ordered or production is authorized.
Unless otherwise agreed in writing, any remaining balance is payable according to the payment terms specified for the project.
Where The Blindsmen performs final measurements, products will be ordered according to those measurements and the specifications approved for the project.
Where measurements, dimensions, construction details, or other specifications are supplied or subsequently changed by the customer, builder, contractor, designer, or another third party, additional costs resulting from inaccurate or changed information may apply.
Custom window coverings require manufacturing and may be subject to manufacturer production schedules, product availability, transportation, and other factors.
Estimated manufacturing, delivery, or installation timelines will be communicated where applicable. Unless expressly agreed otherwise in writing, stated timelines are estimates.
We will make reasonable efforts to communicate material delays.
The customer is responsible for providing safe and reasonable access to the areas where measurements or installation will take place and for ensuring that those areas are reasonably ready for installation.
Nothing in this section limits rights available to consumers under applicable law. Ontario law establishes specific requirements and remedies for certain future-performance consumer agreements, including circumstances involving late delivery or performance. Ontario
Product samples, photographs, website images, and digital representations are intended to provide a reasonable representation of our products.
Actual appearance may vary due to lighting, screen settings, dye lots, natural materials, texture, manufacturing processes, and other characteristics of the product.
Reasonable variations inherent to fabrics, woods, natural materials, or manufacturing processes are not necessarily product defects.
Motorized and automated window coverings may require compatible electrical power, wiring, outlets, transformers, wireless networks, hubs, applications, or other infrastructure depending on the selected system.
Unless expressly included in the project scope, electrical work or other third-party infrastructure is not included in our services.
Compatibility and functionality may also depend on equipment, software, networks, or services supplied by third parties.
Warranty coverage varies by product, component, and manufacturer.
Specific warranty information applicable to a project may be stated in the customer's estimate, invoice, product documentation, or agreement.
The Blindsmen will assist customers with eligible warranty claims relating to products supplied by us.
Manufacturer warranties may exclude matters such as normal wear and tear, misuse, accidental damage, unauthorized alterations, improper handling, or other conditions specified by the manufacturer.
Nothing in these Terms excludes or limits warranties, conditions, rights, or remedies that cannot lawfully be excluded or limited.
Because most of our products are custom manufactured to customer-approved measurements and specifications, they generally cannot be returned or exchanged simply because a customer changes their mind once production has commenced.
Any available cancellation, modification, return, replacement, or refund will depend on the circumstances of the project, manufacturer requirements, the applicable agreement, and applicable law.
Nothing in this section limits any cancellation, refund, or other consumer right provided by applicable law.
Unless otherwise indicated, the content of this website, including The Blindsmen name, branding, logos, text, graphics, designs, photographs, and other original materials, is owned by or licensed to The Blindsmen Inc.
Such content may not be reproduced, distributed, modified, or commercially used without authorization, except as permitted by law.
Our website or services may interact with or link to third-party platforms, manufacturers, payment processors, appointment systems, or other services.
The availability and operation of those third-party services are subject to their respective terms and policies.
To the extent permitted by applicable law, The Blindsmen Inc. will not be liable for indirect, incidental, special, or consequential losses arising solely from the use of this website.
Liability relating to a particular customer project will be governed by the applicable agreement and applicable law.
Nothing in these Terms excludes or limits liability, rights, warranties, or remedies where doing so would be prohibited by law.
